Grandmother says she wont give son to Curry
March 20th, 2009 Posted in NBA basketball newsThe grandmother of Eddy Currys 3-year-old son said she plans to disobey a Cook County judges order on Thursday to turn the boy over to the New York Knicks player.
Yolan Henry told the Chicago Tribune after a custody hearing that she considers herself to be on the run. She said shes trying to protect Noah Curry, not kidnap him.
I feel that its unfair to subject this child to a turnover when he doesnt know the parties he is being turned over to, she told the Tribune. We are forced to be fugitives.
Henry has had custody of the boy since her daughter, Nova, and infant granddaughter, Ava, were fatally shot in their Chicago town house in January. Noah Curry was there but unharmed.
Judge Fe Fernandez on Thursday ordered Henry to turn the boy over to his fathers attorneys, who have the option of calling law enforcement to take custody. Curry, who was at the courthouse on Thursday, declined to comment after the judges ruling.
Yolan Henry told the Tribune she plans to file an appeal with the appellate court on Friday to challenge the ruling. She did not return a telephone message Thursday from The Associated Press.
Attorneys for both sides met Thursday evening with representatives from the Cook County sheriffs office, which expected an orderly transfer of custody within the next day or so, said sheriffs office spokesman Steve Patterson.
The case is very emotional, said Kelly Saindon, Currys attorney.
You guys know the tragedy behind this story, so its an unfortunate turn of events, Saindon told reporters.
Fredrick Goings, a 36-year-old attorney who once dated Nova Henry, is charged with killing her and her child. He is being held without bail. Goings represented Henry in a paternity case with Curry.
